‘martinesingh.com’ proposesthe sale of works of the mind in various forms, original prints, limited series, reproductions on objects or fabrics…
‘martinesingh.com’ is represented by the Trade Martine Singh, the owner of the aforementioned site.
The administrative and the production are located at the following address: 4 rue Georges Lemesle – 14370 – ARGENCES (France). Activity registered at the Chamber of the business and the industry of the city of CAEN (14000)-France SIRET 531 413 128 00012 - APE 1812Z.
The conditions of sale are considered to be known by the purchaser before the order is made. Any order implies acceptance by the purchaser of all the general conditions of sale.
The present general conditions and related headings represent all of the rights and obligations of the parties concerning the ordering of products on the Internet. No general or specific condition communicated by the customer will be integrated into the present general conditions of sale.
Copyright
Buying a product means that you become the owner of the object in question but not of the image itself. The trade Martine Singh alone has the rights relating to her works. These rights of use and distribution remain entirely her own property and are not dependent on the artistic quality of the graphism, the illustration or the image, but on the use which is made of it. Any use, distribution, representation, counterfeit or reproduction, total or even partial of the work is prohibited without the written agreement of the trade Martine Singh.
Prices
The prices of the products indicated on “martinesingh.com” are considered exacts since 01/04/2011. These prices are in euro, inclusive of tax. Those expressed in currencies other than euros are given as an indication. The ordered articles are invoiced on the basis of current prices at the time the order is recorded, not including post and packaging.
The carriage costs are paid by the customer. They include a participation in the costs of preparation, packaging and postage costs. They are invoiced to the customer at the tariff shown on the order form according to the weight and the nature of the article, the geographical area and the shipping method. For any delivery outside Metropolitan France, possible customs charges or local taxes remain the responsibility of the customer.
The indicated prices are susceptible to be modified without advance notice, according to the evolution of the prices of “martinesingh.com”‘s suppliers.
Order
The customer places his order via the website ‘martinesingh.com’. To avoid any attempt at fraud, ‘martinesingh.com’ cannot honour orders whose addresses are PO boxes.
Confirmation of order
As soon as the customer’s order has been recorded, ‘martinesingh.com’ sends him a confirmation email. By saving or printing this e-mail, the customer has proof of his order. ‘martinesingh.com’recommend him keep it.
24 hours after this confirmation, the customer’s order is considered to be firm and final. ‘martinesingh.com’therefore invite the customer to inform her by e-mail of his intention to cancel before the end of this time-limit at ms@martinesingh.com, specifying his surname, first name, address and order n°.
In the event of supplies being out of stock, ‘martinesingh.com’will contact the customer in the three working days following the sending of the confirmation email, to offer him either a new delivery period of the product, or a replacement product, or the cancellation of the order.
For any personalized order that the customers clearly define some characteristics at the time of his order (details of the image, format, atmosphere, collage…), no cancellation will be taken into account in accordance with article L.121-20-2 of consumer legislation (exclusions of the right of withdrawal) of French law. ‘martinesingh.com’will confirm the departure of the customer’s parcel by e-mail.
Means of payment, invoicing
In application of the French law of 12 May 1980, ‘martinesingh.com’ retains the ownership of the product until full payment of the price has been made by the customer.
The price of the articles ordered is payable in full to ‘martinesingh.com’ as soon as the customer’s purchase order has been issued on the website ‘martinesingh.com’, according to the following payment method:
- by bank card (secure payment on line).
The acquitted invoice will be enclosed with the customer’s parcel.
Delivery and return methods
The products will be delivered to the address the customer indicates. In the event of error by himself in the wording of the recipient’s contact details (name, first name, number and street name, post code, name of city, telephone number or email address), ‘martinesingh.com’ cannot be held responsible for the impossibility of delivering the products he ordered. In this case, ‘martinesingh.com’will contact him in order to regularise the situation as rapidly as possible.
Whether the customer order from France or from abroad, ‘martinesingh.com’ can deliver to his home, to the address indicated by himself. The parcel will be given directly to the stated recipient, except if this person is absent, when a note reporting its availability will be addressed to him.
The delivery times are indicated as exactly as possible. They include the time necessary for making the prints on the objects and possible additional work, the parcel preparation time as well as the routing time. Exceeding the delivery times cannot give rise to damages.
As soon as the order is received, the recipient must check the condition and conformity of the delivery. If the package is too damaged, the customer must ‘refuse’ it and have the fact noted by the post office. “martinesingh.com’ pleased the customer to inform her immediately of any such facts by email.
All complaints relating to a defect, an inaccuracy in the quantities or an erroneous product in comparison to the confirmation of th customer’s order will have to be formulated in writing (email or recorded delivery letter) within three working days from the date of receipt of the parcel.
The cooling-off period granted to the customer for the purchase of the products is seven clear days from the date of receipt of the order. During this time, the customer can return, at his own expense and without other penalties, the products which are not suitable for him. he will then be able to choose the refund of the sums paid or the exchange of the ordered reproduction(s). No product can be refunded or exchanged before being sent back by himself, in its original packaging, at his expense and at his own risk. These products must be received by the services of ‘martinesingh.com’in perfect condition, as delivered by themselves. The product must not have been unsealed and must have no print, stains, scratches or similar. For any personalized order, the customer of which had clearly defines the characteristics during his confirmation of order, there is no possible return.
martinesingh.comdeclines all responsibility for any failure to observe its contractual obligations in the hypothesis of force majeure or chance happening, such as disaster, administrative decision, failure or an internal or external breakdown, natural disaster, war, riot, fire, internal or external strike and generally speaking any event not allowing the correct execution of the orders. ‘martinesingh.com’will keep the purchaser informed as and when appropriate, of the cases or the events enumerated above.
Dispute
In the event of difficulty relating to the interpretation or application of these conditions of sale, the parties will try as far as possible to solve their dispute amicably.
This contract is subject to French law. In the event of failure of the attempts mentioned above, the French courts will be the only ones deemed competent.
